End-User Licence Agreement

1. Licence grant

FNC Labs (Pty) Ltd grants you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on a device that you own or control, for your own personal, non-commercial use, subject to this EULA, the Terms of Service and the rules of the platform you obtained the App from (Apple's Licensed Application End User Licence Agreement for iOS users, Google Play's Terms of Service for Android users).

2. Reservation of rights

The App is licensed, not sold. FNC Labs (Pty) Ltd retains all right, title and interest in and to the App, including the source code, the GLP Wise name, wordmark, icon, the Wise Teal palette and all artwork. No rights are granted by implication, estoppel, or otherwise. Any rights not expressly granted are reserved.

3. Restrictions

You may not, and you may not permit anyone else to:

• copy, modify, adapt, translate or create derivative works of the App;
• reverse engineer, decompile or disassemble the App, except to the extent that South African law expressly allows it despite this restriction;
• rent, lease, lend, sell, sublicense, distribute or otherwise transfer the App to any third party;
• remove, alter or obscure any proprietary notices on the App;
• use the App in a way that is unlawful, that infringes any third-party right, or that breaches our Acceptable Use Policy;
• use the App to develop a competing product, or to scrape data from our servers in bulk.

4. Updates

We may release updates to the App from time to time. Updates may add, change or remove features. You agree to install updates promptly — older versions may stop working with our servers as we evolve the API. Updates are governed by this EULA unless a separate licence is provided with them.

5. Subscriptions and Pro features

Some features of the App require a paid GLP Wise Pro subscription. Subscription terms, pricing, the 7-day free trial, auto-renewal and cancellation rules are set out in the Terms of Service §8 and the Refund & Cancellation Policy. All payments are handled by Apple In-App Purchase or Google Play Billing — FNC Labs (Pty) Ltd never sees card details.

6. Privacy

Your use of the App is also subject to our Privacy Policy. The Privacy Policy explains what personal information the App collects, why, who else processes it (OpenAI, RevenueCat, Sentry, Apple, Google), and how to exercise your POPIA / GDPR rights.

7. Health disclaimer

The App is a self-management tool. It is not a medical device. It does not diagnose, treat, cure or prevent any disease, and it is not a substitute for the advice of a qualified healthcare professional. See the Health Disclaimer for the full statement.

8. No warranty

The App is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory or otherwise, except to the extent that warranties cannot be excluded under the South African Consumer Protection Act 68 of 2008. To the maximum extent allowed by law, FNC Labs (Pty) Ltd disclaims all implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, FNC Labs (Pty) Ltd's total liability under this EULA, whether in contract, delict (including negligence) or otherwise, will not exceed the amount you paid us for the App in the 12 months immediately before the event giving rise to the claim, or ZAR 1,000 if you have not paid us anything. We are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data. Nothing in this section limits liability that cannot be excluded under South African law.

10. Termination

This EULA stays in force until you stop using the App or we terminate it. We may terminate this EULA at any time if you breach any of its terms. On termination, your licence ends, you must uninstall the App, and any sections that by their nature should survive (e.g. ownership, no-warranty, limitation of liability, governing law) survive termination.

11. Apple-specific terms (iOS users only)

If you obtained the App from the Apple App Store, the following also applies:

• This EULA is between you and FNC Labs (Pty) Ltd only, not with Apple. Apple is not responsible for the App or its content.
• The licence granted by this EULA is limited to a non-transferable licence to use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms.
• Apple has no obligation to provide maintenance or support services for the App. Any maintenance or support is provided by FNC Labs (Pty) Ltd at support@glpwise.com.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• If a third party claims that the App or your use of it infringes their intellectual property rights, FNC Labs (Pty) Ltd, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

12. Governing law and jurisdiction

This EULA is governed by the laws of South Africa. Any dispute is subject to the exclusive jurisdiction of the courts of South Africa, sitting in the Western Cape Division of the High Court (Cape Town).
